E-SWIATLO.PL ONLINE STORE TERMS AND CONDITIONS

§1. General Provisions

1. The online store available at www.e-swiatlo.pl, hereinafter referred to as the "Store," is operated by:

hereinafter referred to as the "Seller."

2. These Terms and Conditions define the rules for using the Store, placing orders, concluding sales agreements, delivering Goods, making payments, creating a Customer Account, filing complaints, and exercising the right to withdraw from the contract. 3. The Terms and Conditions are available free of charge on the Store's website, allowing them to be downloaded, saved, and printed.
4. The Customer is obligated to use the Store in accordance with applicable law, the provisions of the Terms and Conditions, and good practice.

§2. Definitions

1. Customer – a natural person, legal entity, or organizational unit making purchases in the Store.
2. Consumer – a natural person making a purchase not directly related to their business or professional activity.
3. Entrepreneur with Consumer Rights – a natural person conducting business activity whose purchase is not of a professional nature.
4. Goods – a product offered for sale in the Store.
5. Sales Agreement – ​​an agreement concluded between the Customer and the Seller via the Store.
6. Customer Account – an individual user panel enabling the placement of orders and data management.

§3. Placing Orders

1. Orders can be placed:

* via the Store's website,
* electronically to the Seller's email address,
* by phone during the Seller's business hours.

2. Orders placed via the website are accepted 24 hours a day, 7 days a week.
3. Orders are placed subject to the provision of data required for order fulfillment and acceptance of the Terms and Conditions.
4. After placing the order, the Customer will receive automatic confirmation of receipt.
5. The sales contract is concluded upon acceptance of the order by the Seller.

§4. Prices and Payment

1. All prices displayed in the Store are gross prices and include VAT.
2. Prices are given in Polish zloty (PLN).
3. Shipping costs are displayed before placing the order. 4. The Customer may pay:

* by traditional bank transfer,
* via Przelewy24,
* BLIK,
* by payment card,
* by another method provided by the Seller.

5. The electronic payment service provider is Przelewy24.
6. In the case of promotions and price reductions, the Seller will display the lowest product price valid for the 30 days prior to the introduction of the reduction in accordance with applicable law.

§5. Delivery

1. Deliveries are made via courier companies and logistics operators cooperating with the Seller.
2. Delivery costs are provided before the order is placed.
3. The order fulfillment time depends on the availability of the Product and is provided with the product or individually agreed with the Customer.
4. If the order cannot be fulfilled for reasons beyond the Seller's control, the Customer will be informed immediately, and all payments received will be refunded within no more than 14 days.

§6. Complaints and Product Compliance with the Contract

1. The Seller is liable to the Consumer and the Entrepreneur acting as a Consumer for the Product's compliance with the contract in accordance with applicable law.

3. The Seller will consider the complaint within 14 days of its receipt.

§7. Right of Withdrawal

1. The Consumer and the Entrepreneur acting as a Consumer have the right to withdraw from a distance contract within 14 days without giving any reason.
2. The withdrawal period expires 14 days from the date the Customer or a third party designated by the Customer takes possession of the Product.
3. The Customer bears the direct cost of returning the Product. 4. The Seller will refund all payments received, including the cost of the cheapest standard delivery offered by the Store.

§8. Personal Data Protection

1. Customers' personal data are processed in accordance with applicable law and the Privacy Policy available on the Store's website.
2. Detailed information regarding the processing of personal data can be found in the Privacy Policy.

§9. Technical Requirements

To use the Store, you must have:

* a device with internet access,
* a current web browser,
* an active email address,
* cookies and JavaScript enabled.

§10. Final Provisions

1. Polish law applies to agreements concluded through the Store.
2. The parties will endeavor to resolve any disputes amicably.
3. If an amicable resolution to the dispute is impossible, the competent court will have jurisdiction in accordance with applicable law.

4. In matters not covered by these Terms and Conditions, the provisions of:

* the Civil Code,
* the Consumer Rights Act,
* the Act on the Provision of Electronic Services,
* the GDPR Regulation shall apply.

5. These Terms and Conditions are effective from the date of their publication on the Store's website.
